General Terms and Conditions for Guests
By creating an account and using our platform to book or inquire about short-term rental properties, you agree to the following terms and conditions:
1. Eligibility
To use our platform, you must:
- Be at least 18 years old.
- Have the legal capacity to enter into a binding contract.
- Provide accurate, complete, and up-to-date information when creating your account and making bookings.
2. Account Creation
- You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activity under your account.
- You agree to notify us immediately of any unauthorized use of your account.
- Accounts may be suspended or terminated for fraudulent activity or violation of these terms.
3. Booking Process
- By making a booking, you confirm that you have reviewed and agree to the property’s listing details, including pricing, house rules, and availability.
- You are responsible for ensuring that the property and its terms meet your needs before making a reservation.
- Bookings are subject to confirmation by the host. A booking is not confirmed until you receive a notification from the platform or the host.
4. Payment and Fees
- You agree to pay the total amount for the booking, including any applicable taxes, service fees, and other charges as specified during the booking process.
- Payments will be processed through our designated payment gateway(s), and there will be applicable fees.
- All charges are non-refundable unless stated otherwise in the host’s cancellation policy or as determined by our platform.
5. Cancellation and Refunds
- You agree to abide by the cancellation policy set by the host for your booking. Each host may have a different cancellation policy (e.g., flexible, moderate, strict).
- If you cancel a booking in accordance with the host’s policy, you may be entitled to a partial or full refund, depending on the timing of your cancellation.
- Any platform or payment gateway fees are non-refundable, even in the event of a cancellation.
6. Guest Conduct
- You agree to behave respectfully and responsibly while staying at the property.
- You must comply with the house rules, including those related to noise, occupancy limits, pets, smoking, and parking.
- You are responsible for any damage caused to the property or its contents during your stay. Hosts have the right to charge you for repairs or replacements.
- You are responsible for your own safety and the safety of any other individuals you bring to the property.
7. Property Access
- You agree to respect the privacy of the host and others who may live or work on the property.
- You must not access areas of the property that are not part of the rental agreement unless authorized by the host.
- If you require special accommodations or assistance, you should communicate this with the host prior to your booking.
8. Prohibited Activities
You agree not to engage in the following activities during your stay:
- Illegal Activities: Engaging in any illegal activities on the property, including drug use or any form of criminal conduct.
- Parties or Events: Hosting parties, events, or gatherings without prior written consent from the host.
- Disturbing the Peace: Causing disruptions or disturbances to neighbours or the surrounding community.
- Subletting: Subletting the property or allowing others to stay without explicit permission from the host.
9. Liability and Insurance
- You agree to hold the platform and the host harmless for any injuries, accidents, or damage that may occur during your stay, except where due to the negligence of the host.
- You are encouraged to have appropriate travel insurance to cover any risks associated with your stay, such as trip cancellations, medical emergencies, or property damage.
10. Platform Rights and Restrictions
- The platform reserves the right to suspend or terminate your account if you violate these terms or engage in any unlawful or harmful activities.
- We reserve the right to remove any content you submit to the platform, such as reviews or comments, which violates our policies or is deemed inappropriate.
11. Intellectual Property
- The content provided on our platform, including text, images, logos, and trademarks, is protected by copyright and is owned by the platform or its licensors.
- You may not use, reproduce, or distribute any content from the platform without prior written permission, except as necessary to use the service.
12. Privacy and Data Protection
- By creating an account, you consent to our collection, use, and processing of your personal data as described in our Privacy Policy.
- You agree to provide accurate and up-to-date information, and you understand that failure to do so may prevent you from using the platform.
13. Communication
- You agree that the platform may send you notifications, promotional messages, and updates regarding your bookings or other relevant services, which can be opted out of as per our Privacy Policy.
- Communication with hosts should be respectful and in accordance with the platform’s communication guidelines.
14. Amendments to Terms
- We may update or modify these Terms and Conditions at any time. You will be notified of any material changes, and your continued use of the platform after such changes indicates your acceptance of the updated terms.
15. Dispute Resolution
- Any disputes between you and the host, or you and the platform, should first be attempted to be resolved through direct communication.
- If a resolution cannot be reached, the platform may provide assistance or mediation. However, the platform is not responsible for resolving disputes or claims between guests and hosts.
16. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of New Zealand.
- Any disputes or legal actions arising from these terms will be resolved in the competent courts of New Zealand.
